Terms of Service

Thank you for using BabyLog! These Terms of Service ("Terms") govern your use of BabyLog and any related services provided by Second Wave LLC ("Company", "we", "us", or "our").

By using BabyLog, you agree to these Terms. If you do not agree, please do not use our service.

Account Terms

1. You must be at least 18 years old to create an account and use BabyLog.
2. You must provide accurate information when creating your account.
3. You are responsible for maintaining the security of your account. Use a strong, unique password and keep your login credentials confidential.
4. You are responsible for all activity that occurs under your account.
5. One person may not maintain more than one account.
6. You may not use BabyLog for any illegal purpose or to violate any laws in your jurisdiction.

Family Sharing

BabyLog allows multiple family members to share access to baby records:

1. Family Owner: The person who creates a family is the owner. Owners can:

• Invite and remove family members
• Add and manage babies in the family
• Transfer ownership to another member
• Delete the family (if no babies remain)

1. Family Members: Invited members can:

• View all babies and records in the family
• Create and edit records
• Leave the family at any time

1. Access Control:

• When you are removed from a family or leave voluntarily, you immediately lose access to all data in that family
• The family owner may transfer ownership to another member
• Only family members have access to family data

Acceptable Use

You agree to use BabyLog responsibly and legally. You may NOT:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to access another user's account or data without authorization
• Attempt to probe, scan, or test the vulnerability of our systems
• Interfere with or disrupt the service or servers
• Use the service to send spam or unsolicited messages
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated methods to access the service without our permission
• Resell or redistribute the service without our permission

We reserve the right to suspend or terminate accounts that violate these terms.

Subscriptions and Payments

Free Plan

The BabyLog free plan allows you to:

• Record unlimited daily care events (feeding, sleep, diapers, etc.)
• Track basic growth measurements
• Share with family members

Pro Subscription

BabyLog Pro unlocks additional features:

• AI-powered parenting insights and analysis
• Advanced statistics and trends
• Additional premium features as we add them

Billing

• Subscriptions are billed through Apple App Store or Google Play Store
• Payment processing is handled entirely by your app store
• Subscription automatically renews unless cancelled
• Manage or cancel your subscription through your app store account settings

Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

AI Features Disclaimer

BabyLog Pro includes AI-powered features that analyze your baby's data and provide insights. Important disclaimers:

1. Not Medical Advice: AI-generated insights are for informational purposes only. They are NOT medical advice, diagnosis, or treatment recommendations.
2. Consult Professionals: Always consult qualified healthcare professionals (pediatricians, doctors, nurses) for any health concerns about your baby.
3. No Guarantees: AI insights are generated by machine learning models and may be inaccurate, incomplete, or inappropriate for your specific situation.
4. Your Responsibility: You are solely responsible for any decisions you make based on information from BabyLog. We are not liable for any actions taken based on AI-generated content.
5. Emergency Situations: In any medical emergency, contact emergency services immediately. Do not rely on BabyLog for emergency guidance.

Content Ownership

Your Content

You retain full ownership of all data and content you create in BabyLog, including:

• Baby profiles and information
• Daily care records
• Photos and attachments
• Notes and observations

By using BabyLog, you grant us a limited license to process, store, and display your content solely for the purpose of providing the service to you.

Our Content

BabyLog and its original content (excluding your content), features, and functionality are owned by Second Wave LLC and are protected by copyright, trademark, and other intellectual property laws.

Service Availability

Uptime

We strive for high availability but do not guarantee uninterrupted service. The service is provided "as is" and "as available."

Modifications

We may modify, update, or discontinue features of BabyLog at any time. For significant changes that affect your use:

• We will provide at least 30 days notice when possible
• We will not remove core functionality without providing data export options

Data Export

You can export your data at any time through the app. We will maintain export functionality for as long as the service operates.

Limitation of Liability

To the maximum extent permitted by law:

1. BabyLog is provided "as is" without warranties of any kind, either express or implied.
2. We do not warrant that the service will be uninterrupted, secure, or error-free.
3. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
4. Our total liability for any claims arising from these Terms or your use of BabyLog is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
5. Specifically for AI features: We are not liable for any decisions, actions, or outcomes resulting from AI-generated content. The AI features are tools to assist you, not replacements for professional advice.

Indemnification

You agree to indemnify, defend, and hold harmless Second Wave LLC and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with:

1. Your access to or use of the Service
2. Your content or data you submit to the Service
3. Your violation of these Terms
4. Your violation of any third-party rights, including intellectual property or privacy rights
5. Any harm caused to a third party as a result of your use of the Service

This indemnification obligation will survive the termination of your account and these Terms.

Account Termination

By You

You may delete your account at any time through the app settings. Upon deletion:

• Your access ends immediately
• Your personal data is permanently deleted within 60 days
• Shared family data remains accessible to other family members

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in illegal activity
• Abuse the service or other users
• Fail to pay subscription fees (for Pro accounts)

We will provide notice before termination unless immediate action is required for security or legal reasons.

Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to contact us at support@babylog.ai and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Jurisdiction

Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Wyoming, United States. You consent to the jurisdiction of such courts.

Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last updated" date
• For material changes, we will notify you via email or in-app notification at least 30 days in advance
• Continued use of BabyLog after changes take effect constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you may delete your account before they take effect.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Second Wave LLC regarding BabyLog.

Definitions

For the purposes of these Terms:

• "Application" or "App" refers to BabyLog, the software program provided by the Company.
• "Company" (referred to as "we", "us", or "our") refers to Second Wave LLC.
• "Content" means any data, text, photos, or other materials you upload, submit, or create through the Service.
• "Device" means any device that can access the Service, such as a smartphone or tablet.
• "Service" refers to the Application and all related features, including the website at babylog.ai.
• "You" means the individual accessing or using the Service.
